These Terms of Service (“Terms”) govern your access to and use of the website and services of Klee Designs (https://kleedesigns.io) (“we”, “our”, or “us”). By accessing or using our website or services, you (“you” or “Client”) agree to be bound by these Terms. These Terms are governed by the laws of Kenya, including but not limited to the Contracts Act, 2011 and the Consumer Protection Act, 2012.

1. Services

Klee Designs provides professional digital services, which may include, without limitation:

  • UI/UX Design
  • WordPress Website Development and Maintenance
  • WooCommerce Solutions
  • Website Audits, Strategy, SEO, and Marketing
  • Advanced Development & Integrations

All services are provided in accordance with professional standards and reasonable skill and care.

2. Client Obligations

By engaging our services, you represent and warrant that you will:

  • Provide accurate, complete, and current information as required for the provision of services.
  • Use our website and services in compliance with applicable laws and regulations.
  • Respect intellectual property rights and refrain from unauthorized use of Klee Designs’ materials.

3. Fees, Payment, and Refunds

  • Service fees will be clearly communicated prior to engagement.
  • Payment shall be made in accordance with the agreed terms specified in the project proposal or invoice.
  • Refunds, if any, will be considered strictly in accordance with the project scope, progress, and any prior written agreements, consistent with the Consumer Protection Act, 2012.

4. Intellectual Property

  • All intellectual property, including but not limited to designs, code, content, and other materials created by Klee Designs, remain the property of Klee Designs until full payment has been received.
  • Upon full payment, ownership rights may be assigned pursuant to the written project agreement.
  • Unauthorized reproduction, modification, distribution, or use of Klee Designs’ intellectual property is strictly prohibited.

5. Limitation of Liability

To the fullest extent permitted by law, Klee Designs shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of our services.
  • Any delays, failures, or disruptions caused by factors beyond our reasonable control, including but not limited to technical failures, internet outages, or acts of third parties.

6. Amendments

  • Klee Designs reserves the right to update or modify these Terms at any time.
  • Any changes shall be effective immediately upon posting on our website. Continued use of our services after such posting constitutes acceptance of the amended Terms.

7. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Kenya, including the Contracts Act, 2011 and the Consumer Protection Act, 2012.
  • Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Kenya.
